Protecting Victims of Spousal Abuse and Domestic Violence

No one should have to live in a dangerous environment or with the threat of violence. If you or a family member has been the victim of domestic violence or threats from a spouse, former spouse, family member or person with whom you have a relationship, you can obtain a protection order (also known as a restraining order or injunction).

There Are Two Types of Protection Orders in New Jersey:

  • Temporary Restraining Order: The first step in the process is to obtain a Temporary Restraining Order. You can obtain a temporary protection order on your word alone. The Law Offices of Irwin D. Tubman, LLC, can advise you if necessary, but you can obtain a Temporary Restraining Order almost immediately, by contacting the police and the court.
  • Final Restraining Order: In approximately two weeks, the court will hold a hearing to determine if your Temporary Restraining Order should become Final. The subject of the protection order will have an opportunity to defend himself or herself. Our firm can represent you at this hearing to persuade the court to issue the order and ensure that your rights are protected. Attorney Irwin D. Tubman can represent you at this hearing to ensure that your rights and safety are protected.

Protecting Those Who Have Been Falsely Accused

It’s not unusual in a contentious divorce or child custody proceeding for one of the parties to make a false accusation of domestic violence to gain the upper hand in the dispute.

If you are accused of spousal abuse, you need to be represented by an experienced domestic violence lawyer. A Final Restraining Order can have a devastating effect on your life. You may be removed from your home and lose child custody or visitation rights. Your career and reputation may suffer, even if the order is lifted in the future. You may be barred from possessing weapons.

Our firm will provide you with assertive representation to challenge the Restraining Order and protect your rights and reputation.
