Spousal Support / Alimony

Jersey City Alimony Lawyer

In certain situations, alimony (sometimes called spousal support or spousal maintenance) can be negotiated as part of a divorce settlement or can be ordered by the court as part of the divorce decree or even during the pendency of the divorce action. In some cases, the court may not order alimony or the parties may choose to forego it.

The Law Offices of Irwin D. Tubman, LLC is an experienced family law firm focusing on divorce and related matters. Attorney Tubman can evaluate your situation, explain your rights, and how he can work to obtain a divorce solution that protects your interests.

The Uses of Alimony

New Jersey courts can order or consent to the payment of alimony for a limited duration or permanent basis. Once awarded, a receiver or payer of alimony may seek to change or modify it, but the court does not have to grant that request. There are three types of alimony:

Rehabilitative alimony — where a former spouse receives support while the person completes education or training designed to allow that person to successfully enter the work force and gain experience.

Limited Duration alimony — awarded in situations where permanent alimony is inappropriate, but alimony for a relatively short time is warranted.

Permanent alimony — awarded in situations involving long-term marriages where a former spouse lacks earning ability — typically due to lack of advanced education, long absence from the workforce, or disability.
