Parenting Time, Custody and Child Support Modifications
There must be a substantial change in circumstances before the court will allow custody / visitation or child support modifications. The following are examples of situations in which a parenting time or child support modification may be granted:
- A parent needing to relocate to another city or state for a job
- A parent losing his or her job or getting a new job
- A parent undergoing a significant change in income
- A parent remarrying
- A parent or child abusing substances (drugs, alcohol)
- A parent having another child
- A child living with an unfit parent
- A child having new/different needs or schedule
We are readily able to assist parents in proving that there is a real need to modify the existing agreements. We then help them file the necessary motions with the court to obtain the relief they need for themselves and their children.
Parental Relocation
If you want to relocate with your child, or if you want to contest relocation, it is essential you obtain legal advice from an experienced attorney.
Under New Jersey law, the parent with primary physical custody of the children must obtain permission from the court to relocate in the event the other parent protests the potential move. The court will then hold a removal hearing and consider a variety of factors in making its decision on whether the relocation is in the best interests of the children. If the relocation is granted, the court will require the parents to create an amended custody arrangement.
Our firm is committed to protecting parental and children's rights. We can represent either parent in the removal hearing and help both sides craft a mutually acceptable visitation schedule. In some cases, this involves modifying a visitation schedule to include blocks of time over holidays or during the summer with the noncustodial parent. We always structure our representation around safeguarding the best interests of the children.
Parent-child communication is essential to retaining good relationships. We encourage parents and children to stay in contact with each other through web cams, internet chat, telephone and other technological means. Even if you can't be near your child physically, you can still be an effective parent through regular communication.
